elder law
As you enter your later years it is important to make sure that you and your assets are protected by careful planning of several aspects of your life. Our multidisciplinary team at Joynt Andrews will be able to advise you on how to structure and protect your assets in order to maximise their benefit to you and your loved ones, as well as provide advice on aspects of your life such as decision-making, health care, and residential matters.
retirement village and rest home advice
Our team recognises that the processes involved in moving house can be exciting, stressful, and that the move itself may be something of an upheaval. We will be there to guide you, from your negotiations with your potential retirement village or rest home, to completion of the transaction.
retirement village occupation right agreements
The process of purchasing and owning a unit in a retirement village is a little different from standard purchase and ownership, and our team will explain the differences, and the implications, of signing an Occupation Right Agreement.
asset protection
Protection of the wealth you have built over a lifetime is important not only for yourself but also for the people you want to pass your wealth on to. That may include ownership structures, family trust considerations, and your will.
An Enduring Power of Attorney is an authority you give, to a person of your choosing, to manage your affairs and make decisions for you including where you become incapable of doing so. In the absence of an Enduring Power of Attorney in these circumstances, it can be necessary for your loved ones to obtain an urgent court order (see below), with resulting delays, stress and substantial costs. There are two kinds of Enduring Powers of Attorney: one which relates to the management of your property affairs, and another which relates to the management of your personal care and welfare. Recent legislative changes to offer protection from abuse have made Enduring Powers of Attorney more complex but more thorough.
enduring powerS of attorney
If your loved one has lost capacity, does not have Enduring Powers of Attorney, and decisions need to be made regarding their personal care or their property, our team can apply for urgent orders from the court to appoint Welfare Guardians and/or Property Managers for your loved one.
